Cuba Visa Terms and Conditions:

1. Introduction
In using this website, you are deemed to have read, understood and agreed to the following terms and conditions:
Travelfab Ltd, trading as Cubavisa.uk is a registered company in England and Wales number (company number) with the address Chester House, 1-3 Brixton Road, London, SW9 6DE, UK.
The following terminology applies to these Terms of Use, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You”, and “Your” refers to you, the person accessing this website and accepting the Cuba Visa terms and conditions. “The Company”, “Ourselves”, “We”, and “Us” refer to Travelfab/Cuba Visa. “Party”, “Parties”, or “Us” refers to both the Client and ourselves, or either the Client or ourselves. All terms applicable to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by online purchase or any other means, for the express purpose of meeting the Client’s needs in respect of the provision of the Company’s stated services/products, under and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalisation and he/she or they are taken as interchangeable and therefore as referring to the same.

2. Privacy Statement
We are committed to protecting your privacy. Authorised employees within the company, on a need-to-know basis, only use any information collected from individual customers. We do not store any payment information; our merchant account does this for us for your safety. We regularly review our systems and data to ensure the best possible service to our customers. Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such activities to prosecute and take civil proceedings to recover damages against those responsible. Furthermore, please check our privacy policy notice.

3. Confidentiality
We are registered under the Data Protection Act 1998; as such, any information concerning the Client and their respective Client Records may be passed to third parties. However, Client records are confidential and, therefore, will not be divulged to any third party other than the Cuban Consulate if required. Clients have the right to request sight of and copies of any Client Records we keep on the proviso that we get reasonable notice of such a request. Clients are required to retain copies of any literature issued about the provision of our services. Where appropriate, we shall issue Clients with appropriate written information, handouts or copies of records as part of an agreed contract for the benefit of both parties.
We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.

4. Disclaimer
Exclusions and Limitations
The information on this website is provided on an “as is” basis. To the fullest extent permitted by law, Cubavisa:

a)  excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including concerning any inaccuracies or omissions in this website and/or the Company’s literature; and

b)   excludes all liability for damages arising from or in connection with your use of this website. This includes, without limitation, direct loss, loss of business, travel arrangements or profits (whether or not the loss of such profits was foreseeable, arose in the ordinary course of things, or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.

5. Payment and Cancellation Policy
All payments would mainly have to be done online unless given a written email that we will charge you in any other way agreed with you; for example, group bookings with ten or more tourist cards would be easier to deal directly with us.
To enable you to pay for your purchase, the Viva Wallet Redirect HPP service is secure, and we do not store any payment details. When you make a payment through Viva Wallet, we send a Viva Wallet booking reference, name, and email to process a payment receipt for you; no other information is sent to Viva Wallet. After you enter your card details, Viva Wallet attempts to take payment and tells us whether the payment was successful or not. Once your tourist card is paid, please contact us immediately (email us if contacting us out of our working hours) if you notice any mistakes, definitely not longer than 2 hours from payment. We reserve the right to deny any amendments if the actual tourist card(s) have been printed or done more than 2 hours in the past. Please be aware that some services will require a signature upon delivery, so please be attentive when expecting your tourist cards. We do not accept cancellations if you have double booked your tourist card or if your travel agent or anyone else has issued the Tourist Cards.

5a. Your Cuban Tourist Cards are not replaceable, transferable, changeable or refundable.   

5b. Due to Covid-19, all tourist cards issued for customers travelling from March 2020 are still valid to be used with matching passports at any time in the future.

6. Availability
Unless otherwise stated, the services featured on this website are only available within the United Kingdom or concerning postings from the United Kingdom. All advertising is intended solely for the United Kingdom market. You are solely responsible for evaluating the fitness for a particular purpose of any forms, downloads, programs and text available through this site. As our online application form mentioned, our tourist Card or Tourist Visa is not valid for direct or via travel from the USA to Cuba. Please check with your local tour operator in the USA for more information. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express wrote consent of Cubavisa.uk. The Company does not warrant that the service from this site will be uninterrupted, timely or error-free, although it is provided to the best ability. By using this service, you indemnify this Company, its employees, agents and affiliates against any loss or damage, in whatever manner; however it is caused.

7. Process and delivery
Our services are for residents living in the UK and to citizenships listed in our online application form; we post documents from and to the UK and a few European countries as per our online application form. We offer Three alternatives for processing your Cuba Tourist Visa/Card(s). It is important to indicate no human action is taken from OUR side when filling out your Cuban Tourist Cards; what you fill in online is printed on your Tourist card by our automated system. We strongly recommend checking the application before you proceed to the payment; please confirm that all details are exactly as per the passport. A confirmation with what you have filled in will automatically be emailed to you; please check your spam box if this email does not appear in your inbox or contact us immediately if there is any doubt.
We do not accept liability for any typos or mistakes you made when you filled in your passport details in our online form. From time to time, we do random checks, and if any obvious error is spotted, we will contact you to ask you about the same; this does not mean that we are liable for any mistakes you make when filling out the form.
Once you complete your application online, we will send you an automated email with the information you provided on our online form. Please check and let us know if there are any mistakes immediately, we may be able to help you change it if your tourist card has not been issued. Your application will appear on a system, being queued to the service requested; we aim to provide you with a quick and efficient service within the time frame we advise online. If you opt to have an office collection,  you will have to inform us by replying to your confirmation email of an office collection; please check with us before you arrive, and we will be more than happy to confirm a time for pickup. We use only Royal Mail, and you are automatically subjected to their postal terms and conditions. The two alternatives are First Class or Special Next Day Delivery. We will email you when we dispatch your document or when ready for office collection. If you choose Special Delivery, we will add The Royal Mail Tracking Number allowing you to check online where your envelope is. We do keep records of postage taking place; once the Cuba tourist visa leaves our office is entirely Royal’s Mail duty to deliver this to your requested address. We are not liable for any damaged or lost item; we will provide you with confirmation of posting from our side if required. We strongly recommend opting for Special Delivery as this is traceable and insured the cost of your Tourist Card. We do not provide consequential loss with any of our services. If any questions, please do not hesitate to contact us at info@cubavisa.uk. Any complaints will have to be done within 10 days from postage.

8. Log Files
We use IP addresses to analyse trends, administer the site, track users’ movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, our web servers automatically log standard access information for systems administration, detecting usage patterns and troubleshooting purposes, including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within Travelfab ltd / Cubavisa on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

9. Cookies
Like most interactive websites, Cubavisa.uk website uses cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those visiting. Some of our affiliate partners may also use cookies.

Without our prior written consent, you may not create a link to our website pages. If you create a link to a page of this website, you do so at your own risk, and the exclusions and limitations set out above will apply to your use of this website by linking to it.

14. Waiver
Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be valid unless it is expressly stated to be such and signed by both Parties. 13. General, The laws of England and Wales govern these terms and conditions. By accessing this website and buying our product or service, you consent to these terms and conditions and the exclusive jurisdiction of the English courts in all disputes arising from such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to, the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms, and the remaining terms will continue to apply. Failure of Cubavisa to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as a waiver of such provisions and shall not affect the validity of these Terms and Conditions or any Agreement or any part thereof, or the right thereafter to enforce every provision. These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by duly authorised representatives of Cubavisa.

15. Notification of Changes Cubavisa reserves the right to change these conditions from time to time as it sees fit. Your continued site use will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our site’s home page and other key pages. Suppose there are any changes in how we use our site customers’ Personally Identifiable Information. In that case, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on our website 30 days before these changes occur. You are therefore advised to re-read this statement regularly.

These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website and undertaking a booking or Contract indicates your understanding, acknowledgement and acceptance of the Disclaimer Notice and the full Terms and Conditions contained herein.
